Welcome to TheHighRest. These Terms of Service ("Terms") govern your use of thehighrest.com (the "Site") and any purchase you make from us. TheHighRest is operated by HYLUK LLC, a limited liability company registered in New Mexico, USA ("we," "us," "our"), 1209 Mountain Road PL NE, STE N, Albuquerque, NM 87110, USA. By using the site or placing an order, you agree to these terms. If you do not agree, please do not use the site.

1. ELIGIBILITY
You must be at least 18 years old, or the age of majority in your country, to place an order. By ordering, you confirm that the information you give us is accurate and complete.

2. PRODUCTS AND DESCRIPTIONS
We sell TheHighRest™ Inflatable Travel Pillow and related items. We try to describe and photograph our products accurately, but colors may appear differently on your screen, and sizes and weights are approximate. We may change or discontinue products at any time.

3. PRICES AND AVAILABILITY
Prices are shown in US dollars unless stated otherwise. We may change prices at any time, but changes do not affect orders already confirmed. If we make a pricing or listing error, we may cancel the affected order and refund you in full.

4. ORDERS AND ACCEPTANCE
Placing an order is an offer to buy. We accept your order when we send a shipping confirmation. We may decline or cancel any order, for example because of stock problems, suspected fraud, or pricing errors, and we will refund any payment already taken.

5. PAYMENT
Payments are processed securely by Stripe and other payment providers shown at checkout. We never see or store your full card number. By paying, you confirm you are authorized to use the payment method.

6. TAXES, DUTIES, AND CUSTOMS
Taxes, import duties, and customs fees depend on your country and how your order is shipped. Please read our Shipping & Delivery Policy for how these charges are handled for your order.

7. SHIPPING AND DELIVERY
Shipping is governed by our Shipping & Delivery Policy. Delivery times are estimates, not guarantees. Risk of loss passes to you on delivery to the address you provided.

8. RETURNS AND REFUNDS
Returns and refunds are governed by our 30-Day Sleep-Easy Returns & Refund Policy.

9. SAFE USE OF OUR PRODUCTS
TheHighRest™ Inflatable Travel Pillow. is a comfort product. It is not a medical device, and we do not claim it treats, cures, or prevents any condition. If you have a neck, back, breathing, or other health condition, consult a qualified professional before use. Please:
- Do not use it while driving or operating any vehicle or machinery.
- Do not use it as a flotation or safety device.
- Keep it away from small children, who could be at risk from an inflatable item or its packaging.
- Do not over-inflate it, and keep it away from sharp objects and heat.
Always follow the use and care instructions on our site.

10. INTELLECTUAL PROPERTY
All content on the site, including text, images, logos, designs, and product names (including TheHighRest™), belongs to us or our licensors and is protected by intellectual property laws. You may not copy, reproduce, modify, or use it commercially without our written permission.

11. ACCEPTABLE USE
You agree not to use the site unlawfully; attempt to gain unauthorized access to it; interfere with its operation; use bots or scrapers without permission; submit false information; or abuse our refund or returns process.

12. REVIEWS AND CUSTOMER CONTENT
If you submit a review, photo, or video, you confirm it is your own, accurate, based on your genuine experience, and does not infringe anyone's rights. You give us a non-exclusive, worldwide, royalty-free license to display, reproduce, and adapt it on our site and in marketing. We may remove content that breaks these terms. We only publish genuine customer reviews. If a reviewer received a product for free or other compensation, we will say so.

13. PRIVACY
Our Privacy Policy explains how we collect and use your personal information. By using the site, you agree to it.

14. THIRD-PARTY LINKS AND SERVICES
The site may link to third-party websites or services. We do not control them and are not responsible for their content, policies, or practices.

15. DISCLAIMER OF WARRANTIES
To the fullest extent permitted by law, the Site and our products are provided "as is" and "as available." We make no warranties beyond those stated in our policies, and we do not guarantee uninterrupted or error-free access to the Site. Nothing in these Terms excludes or limits any warranty or right that cannot legally be excluded.

16. LIMITATION OF LIABILITY
To the fullest extent permitted by law, HYLUK LLC, its members, employees, and suppliers are not liable for any indirect, incidental, special, or consequential damages, or for loss of profits, data, or goodwill, arising from your use of the Site or our products. Our total liability for any claim relating to an order will not exceed the amount you paid for that order. Nothing in these Terms limits liability for death or personal injury caused by our negligence, for fraud, or for anything that cannot be limited by law.

17. INDEMNIFICATION
You agree to indemnify and hold us harmless from claims, losses, and expenses (including reasonable legal fees) arising from your breach of these Terms or your misuse of the Site.

18. YOUR LEGAL RIGHTS
If you are a consumer in the European Union, the United Kingdom, Switzerland, Canada, or any other country with mandatory consumer protection laws, nothing in these Terms affects the rights you have under those laws, including any right to cancel an order or to take a dispute to your local courts.

19. GOVERNING LAW AND DISPUTES
These terms are governed by the laws of the State of New Mexico, USA, without regard to conflict-of-law rules. Subject to section 18, any dispute will be resolved in the state or federal courts located in Bernalillo County, New Mexico, and you agree to their jurisdiction. Before starting any formal dispute, please contact us at contact@thehighrest.com so we can try to resolve it.

20. CHANGES TO THESE TERMS
We may update these terms from time to time. The updated version applies from the "Last updated" date. Continued use of the Site after changes means you accept them. Orders already placed are governed by the Terms in effect when you ordered.

21. SEVERABILITY AND ENTIRE AGREEMENT
If any part of these Terms is found unenforceable, the rest remains in effect. These terms, together with our shipping & delivery policy, returns & refund policy, and privacy policy, are the entire agreement between you and us.
